LHC rejects PMLN Lahore Mayor LG tenure extension appeal


Justice Jawad Hassan of Lahore High Court LHC on Friday dismissed the petitions moved  by Lahore’s lord mayor Col (r) Mubashir Javed  seeking provision of time/period excluded from their tenure as local government representatives due to the suspension of the system by the Punjab government.

Petitioners took the plea that the representatives were aggrieved of the illegal dissolution of the local government without following the procedure of the succeeding legislation in 2019 by which they were deprived of representing the electorate for almost 22 months.  Petitioners counsel claimed that they had been denied the legitimate expectation to serve the public interest of their constituents.

He said that this action against the petitioners was not only against the doctrine of democracy but also infringement of their fundamental rights guaranteed under Article 17 of the Constitution. He requested to direct the government to issue a notification in respect of the period the petitioners remained out of their offices.

He further requested to restrain the government from holding local government elections expiry of the petitioner’s tenure.

An additional advocate general while opposing the petitions said that this issue was not maintainable before a High Court. He pointed out that the Supreme Court in its verdict regarding the restoration of the suspended local government system had declared that the Punjab Local Government Act of 2019 was lawfully passed, however, nullified its section 3 only that was about the dissolution of the government.


He said that the petitioners should have a review petition before the apex court.

Judge after hearing the  counsels dismissed the petitions.
