Justice Muzzamil Akhtar Shabbir of Lahore High Court on Thursday dismissed a petition seeking removal of Punjab Governor Chaudhry Muhammad Sarwar.
The judge held that hat the Punjab Governor enjoyed constitutional immunity and no petition could be filed against him.
Shahid Aurakzai submitted that contrary to the federal government’s policy, the Punjab government had announced a subsidy on the sugar export this year.
He asserted that Governor failed to use his influence under Article-105 of the constitution to bar the provincial government from doing this which was in violation of the federal government’s command.
He submitted that the governor did not even inform the federal government of the advantages of sugar export to Punjab otherwise the sugar crisis could have been prevented.
The petitioner requested that since Ch Sarwar was not fulfilling his duties, he should be removed from the office of governor.
Judge after hearing the arguments, dismissed the petition as not maintainable.
